Here is the current Flat Tax rate for France :
Since January 1, 2026, the flat tax has increased from 30% to 31.4%. Retroactive, this new flat tax will apply to crypto gains realized in 2025 and declared in 2026.
The new tax is now broken down as follows:
Income Tax: 12.8%
Social Contributions: 18.6% (instead of 17.2%)
Before this date, the rate was 30% (12.8% + 17.2%).
The €305 Exemption:
Your overall capital gain realized during the year is taxable if the total of your taxable sales is greater than 305 euros. If your total taxable sales are less than €305, you are therefore exempt from taxation. The exemption applies if you have less than €305 in taxable sales, not €305 in capital gains.
⚠️ The exemption does not mean you have no tax obligations. Indeed, even if you are eligible for the exemption, you must still:
Fill out Form 2086 attached to your income tax return, which allows you to declare your taxable transactions. Once this form is filled out, if you are under €305 in taxable sales, the administration will indicate that you are tax-exempt;
Fill out Form 3916-bis attached, allowing you to declare your accounts opened, held, used, or closed abroad during the current fiscal year.
💡 The tax calculation provided by Waltio will always indicate your tax amount for information purposes. Thus, we may indicate a tax amount equal to or lower than €305. This means that, in theory, you would have had to pay this amount to the tax authorities, but in practice, you will be exempt.
⚠️ The tax exemption for capital gains in cases where the annual sales amount is less than €305 must not be confused with a tax allowance. Therefore, if the total of your taxable sales exceeds the sum of €305, you are taxable on the entirety of the capital gains without benefiting from a €305 allowance. For example, if you realized taxable sales for an amount of €306, you are taxable on the entirety of this sum.
⚠️ Taxable sales under €0.50 do not need to be declared. Indeed, the tax administration rounds down, which results in zero-value transactions, and they will therefore not appear on Form 2086.
